Bilaspur । That both M/s Celex Technologies Pvt. Ltd. and M/s FTA HSRP Solutions Pvt. Ltd are trying to mislead the media houses as both the companies were well known that they were not qualifying the eligibility conditions of the tender.
 
That M/s Celex Technologies Pvt. Ltd. and M/s FTA HSRP Solutions Pvt. Ltd. participated in the tender of HSRP floated by the Chhattisgarh Transport department, despite the fact that they were not meeting the eligibility conditions which is self explanatory from their pre Bid meeting queries sent to the department. Both the companies in its pre Bid meeting stated that do not have the Technical Experience as sought in the IFB, clause 1.1.4. Copy of the letter of Celex and FTA is enclosed
 
The technical experience clause mentioned in the IFB is as below:-
 
The Sole Bidder / Lead Bidder (in the case of Consortium) must have Technical Experience in in executing/executed High Security Registration Plate Project for at least 5 whole States/ Union Territories in India for a minimum period of one year, in last five financial years. The scope of such contract should be for implementing HSRP in all RTO’s / DTO’s of the respective State / Union Territory..
 
However they participated in the said tender intentionally knowing that they were not meeting the legibility conditions and are now misleading the media houses/agencies and the Hon’ble Courts by mentioning that that the price of the Petitioner is 31% less than that of L1, so that the petitioners could enter the race without qualifying the eligibility conditions. The same is merely a tactics adopted by both the companies to derail the implementation scheme in the State of Chhattisgarh.
 
That the said companies by filing a writ petition approached the Hon’ble High Court of Raipur at Bilaspur, wherein all such facts were brought to the notice of the Hon’ble High Court. That the department in its reply clearly stated that the M/s Celex and M/s FTA were disqualified on the following grounds:
 
That both the Companies intentionally did not enclosed the relevant documents in its Writ Petition in the Hon’ble High Court. The petitioners (M/s FTA and Celex) intentionally did not annexed its Pre Bid meeting queries and the reply uploaded by the State Government in the e procurement portal, in the writ Petition. That from the pre Bid queries of the petitioner and the reply to the Pre Bid queries by the department, it was clear to the petitioners that were not meeting the eligibility conditions.
 
However after a lengthy hearing and arguments, the Hon’ble Court of Raipur of Bilaspur vide its order dated 16.02.20222 and 18.02.2022 dismissed the interim relief as sought by M/s Celex and M/s FTA. Copy of the order dated 16.02.2022 and 18.02.2022 are enclosed.
 
That both the companies have filed SLPs in the Supreme Court of India against the order dated 16.02.2022 and 18.02.2022 passed by the Hon’ble Court of Raipur of Bilaspur.
